The Board wants to address and post responses to recent questions and issues brought to our attention. Our legal counsel advised us to always refer to our deed restrictions when questions arise. Where the deed restrictions are vague, we rely on legal assistance. All of our responses below are based on actual legal advice and/or what guidance our deed restrictions offer.
BURNING
Per Homebuilder requirements – NO Burning is allowed in the Summit Estates at Fischer-any violation by a builder (including his employees or subcontractors) of the burn ban will result in a $500 fine.
ROADS
Great news for Summit Estates residents! Please be advised we will undergo road work starting October 5, 2021. Thank you for your patience and understanding while this update is in progress.
SECURITY
A new LPR 24/7 security system is in place to aid in the prosecution of damages to our property and most importantly ensure the utmost safety of our residents!
SHORT-TERM RENTALS
Legal counsel has advised the Board that relatively recently the Texas Supreme Court in the Tarr vs. Timberwood Park Owner’s Association, Inc. clarified that a restriction as to residential uses only or prohibiting commercial uses did not prohibit short-term type rentals unless the restriction is very specific about regulating or prohibiting leasing. Our deed restrictions do not mention long-term nor short-term renting; therefore, it does not appear that short-term rentals are classified any differently than long-term rentals. Since our covenants do not specifically address long-term or short-term rentals, the current law states that both are allowed within Summit Estates.
The Maintenance Board works very hard to resolve questions and concerns. We encourage everyone to reach out to us via our webpage. If you do not receive an immediate response, please be patient. We are usually awaiting an answer or interpretation before giving our reply. The language in our deed restrictions can be indistinct, therefore, some thought must be given to each concern. While our own personal feelings or opinions may differ from the ultimate decision, know that we are always working to render a legal, fair and enforceable outcome.
